Process servers play an important role in ensuring the due process of individuals as identified in the U.S. Constitution is upheld. They do so by informing individuals of legal actions/notices in which they are involved. When a lawsuit or a legal action occurs against an individual or party, the plaintiff is responsible for notifying the defendant that they are being sued or that there is legal action occurring. The notification occurs through various types of legal notices. It is the role of the process server to deliver these notices to the involved parties in accordance with Oklahoma law. Process servers must be licensed and meet certain qualifications. The National Association of Processional Process Servers (NAPPS), in which we are a member, is a worldwide professional organization which upholds high ethical standards for the profession and ensures that its’ members have a complete understanding of the codes of conduct expected of process servers.
The type of documents served vary depending on what type of legal case is occurring. They may include but are not limited to:
Summons is a notification that the defendant is being sued and it lists the date the defendant needs to appear in court.
Complaint is a legal action that starts a civil action by the filing of a pleading.
Subpoena is an Order issued by the court that requires a person to appear in court or other legal proceeding.
Writ is a formal order from the court that requires a person to stop doing something or orders them to do something specific.
Other court documents – Can include orders, judgements, divorce papers, evictions, bankruptcy petitions, restraining orders, statutory demands, substituted service, freezing orders, contact orders, service by mail, litigation support, citations, court filing, mandamus, and more!
A process server is responsible for delivering legal documents to individuals or parties regarding an impending court date or documents regarding a court case that they are involved with. It is the responsibility of the process server, once the document has been properly “served” according to the requirements of Oklahoma state law, to submit the evidence or an affidavit of proof of service to the courts. Trying to locate individuals to deliver
legal notices
or summons to ensure that their due process is protected is not always an easy task. Direct delivery to the individual is the preferred method, but sometimes it is not possible to put it directly into the intended person’s hands. After making various attempts of direct delivery by to the persons’ home or place of business, or following the individual in a public place,
other methods
may need to be utilized. These may entail the delivery of the legal notice to another adult at their principal place of residence or employment, or service by mail (certified mail with return receipt). Process servers will never leave papers in an individuals’ mailbox, intimidate, or harass the intended recipient or impersonate an officer of the law.
